Call Blizzard, and act like nothing ever happened...
Call up, talk to billing about changing the email on your account.
Even if your not the registered name on the account, say you are, how are they gonna know?
So heres a example convo
My Real (fake) Name :Billy Owned
My Account Registered name :Bob Leet
Blizzard Rep: Hello, thank you for calling blizzard billing support, my name is john, may i please have your phone number, area code first.
Billy Owned: 555-555-5555 (of course give them your real number)
Blizzard Rep: Name please?
Billy Owned: Bob Leet
Blizzard Rep: Thank you bob, what can I help you with today?
Billy Owned: Can I get the email changed and the password reset on my account please?
Blizzard Rep: Yes you may, may I have you account username.
Billy Owned: IPWNBLIZZARD
Blizzard Rep: Ok, sir, I'm gonna have to have you answer a something for me please.
Billy Owned: Yes?
Blizzard Rep: INSERT SECRET QUESTION HERE!!!
Billy Owned: INSERT SECRET ANSWER HERE!!!
Blizzard Rep: Ok, thank you, now what do you want your new email to be.
Billy Owned: [Only registered and activated users can see links. ]
Blizzard Rep: Ok, that information is all updated for you, is there anything else I can do for you?
Billy Owned: Can I get a password reset also?
MAKE SURE YOU DO THIS!!!!!!!!!!! If you don't you won't have access to the account, just do it at the end.
Blizzard Rep: Yes sir! You should get that e-mail in 5-10min
Billy Owned: That is all, thank you for your help!
Blizzard Rep: Thank you.
I've done this MANY times without them asking me why I was changing it, so, just say nothing about the account being hacked or anything, but if they do ask, just say you can't access that email anymore.

I can vouch that this works. Once while trying to scam gametime, the site kept my account. I just called up blizz and it was so easy to get my email (i didn't have access to the old one) and my password changed at the same time! No joke, it's really easy to do as long as you are calm and nice about it.
Just sold two accounts doing this, I mean think about it, they ask you for the information, you provide the correct information, you get what you ask for....

no it works.
i just did this on an account i traded over a year ago.
if you have the name on the account and the SQ/A they'll change the email no problem.
i was hoping to cash in on a great lock, but apparently after we traded he transfered it off the account :[
This DOES work. I have done it to recall an account scammed off of me while selling.
They ask you for your full name and spelling. The representative I had even ave me my secret question because anyone can find out in password retrieval - and made me answer it.
The e-mail got changed back to whichever I wanted, no questions asked. An email was sent to me giving me a randomized new password to the account.
This works 100% but if you do it too many times your account may get flagged too much and they might just freeze it.
