I was browsing the customer service forum, and a guy was saying how someone took his 900g and never gave him the mount code. The GM's reply was this:

You CAN get banned.. But only temporarily or get a warning.. No perm bans for scammers.... yet.

If you buy gold and never get the gold, Blizzard will tell you "too bad, it's against the rules"... but then you and the seller will get bannT.
This is sort of the same thing. It dosnt matter if they guy cant get his money back because it was an illegal transaction, they will ban you ANYWAYS because it IS an illegal transaction.
