According to the blizzard World of Warcraft EU and US sites, it states this.
"Scamming another Player
This category includes:
Acquiring items or any other "possessions" from another player through misinformation, confusion, or fraud (Scamming)
If a player is found to have perpetrated a scam, he/she may:
Be temporarily suspended from the game
IMPORTANT
Repeatedly violating any area of the Terms of Use (ToU), including the area detailed above, will often result in temporary suspension from the game."
So you can scam all you want and not worry about being perma banned! You will probably get a 3 day suspension, but you will still be able to keep your account.
Have fun with scamming! Nice chance to use the Turtle Mount scam to earn loads of money without the worry about perma bans.
Note: With the turtle mount scam, i would like to note, if you do tell the person that wants to buy it, that you are goin to send them just a plain letter, you can't be reported! You let them know exactly what they are getting, even though they think a code is inside that set letter! Have fun with your Gold Earnings!

HAHA! why are people still posting stuff like this??? you can get temp ban yes, but you can also get banned completly just for using a music player on your comp other than WM or itunes lol FACT!

how come I got this.. read the end of it.
BTW when you got the game and after every patch you sign a contract that means if you break any of thier rules.. like if they make a new rule that doesnt allow ppl with the name Bob to play.. then if they find out your name is Bob they will ban you.

The OP is right in the he quoted, but basically they arent noting they can also perma ban you.
Just cause it doesnt SAY they will perm ban, doesnt mean they wont.... Now if it actually said: "You will never been perma banned for scamming." then thats a diff story.

lol Blizzard owns u buddy if they want they can say hmm....u know that guy plays by the rules to much lets perma--ban him for fun but 1st just tele him to a wide open area like the sea and spawn illidan on him then kick him/ban
yah they could do that if they wanted to its there game and they modify that to any way or who they want so /pawnt i do agree tho

According to that they shouldn't ban you... not that they wouldn't ban you, there is a great difference between shouldn't and wouldn't, and blizz pwns all... so yes they will ban you...

Ya, in the TOS they can ban you for anything at all, and my friend scammed people with the present scam, and got 600+g and got mostly all of it taken away

First off, this post is sort of wrong. You technically CAN be perma banned for scamming, but its not likely, and probably won't happen. The reason it will not happen is because you get a few warnings or temporary suspensions before you get permanently banned. So, if you got an email saying "NOTICE OF FINAL WARNING", and you scammed after that, than you would likely be banned. If you are afraid of scamming once, then that's okay, but you WON'T get banned for a first offense. Sure, it is possible, but thats not what Blizzard would do. The only reason they included that little bit in the ToS that said they could ban you for whatever is incase someone comes up with some new hack/cheat/method for WoW that Blizzard isn't comfortable with. It's not referring to scamming becauase there are already comments about scamming in the ToS (temporary suspension.) We all know that it is possible, but if you have never gotten warned/temp banned before, and saw, for example, Flying Piggy's new backspace scam, and wanted to try it out, you WILL NOT get banned, and that's a promise.
