You make another account in his name. Then you use PCT (Paid Character Transfer) to take the toon off his account
Sooo, in step-by-step.
1. Buy a battlechest
2. Register it in his name
3. Use PCT on the old account to transfer the toon to the new account
4. This is optional but it's usually a good idea to ban his account

And another thing you should remember is that if this is done on EU you need access to the email registered to the account aswell
