Its quite easy to ban an account, just call blizzard, tell them your account was stolen, and supply the info (if you have it...). If that doesn't work, there is a program someone made (Can't remember where/what forum it was made in) that makes it so it tries to log in multiple times on your account with different IPs, which soon gets your account locked, etc.

Edit: [Only registered and activated users can see links. ] is the program, should get the job done if what the Poster said is really true. (even though I haven't actually tested it yet...)
