Punishment
The punishment for infringement of copyright, as laid down under section 63 of the Indian Copyright Act, 1957, is imprisonment for six months but which may extend to three years and with fine which shall not be less than Rs. 50,000 but which may extend to Rs. 2,00,000. The punishment, in case of a second and subsequent conviction shall not be less than one year but which may extend to three years and with fine which shall not be less than Rs. 1,00,000 but which may extend to Rs. 2,00,000.
Seeing the foul side of the Copyright infringement, it is advisable that any person who wishes or intends to make use of any copyrighted work should do so either by taking prior written permission or through an explicit contract or license with the author or publisher and thus avoid infringement claims.

It will be really interesting how the process continue, Scape is still online under a new domain they only had database issues today on the website and she is still the official owner of the servers. She needs to proof now that they didn't used Blizzard material and that the money was for other purposes then she may has a chance to get only a small punishment.
The future of Scape is unknown.
(I don't play on Scape and I'm not related with Scape at all, this post is based on facts)

Interesting, now Blizzard is going after the owner and not shutting down the servers like they did before. I wonder what will happen to her...

Not exactly, there was a DMCA sent to scape, but peyton changed the name to ScapeGaming and evaded it. Apparently Blizzard wasn't too happy with that.

No, its because copyright infringement is srs business. People dont like it too much when you steal their game and start profiting off of it.

Here it is a quite difficult case because as long as she doesn't use any Blizzard material (In form of graphics, DBCs, Maps...) they cant punish her that hard. Also Peyton got more then enough money to get like 20 lawyers who will help her. She got only over Scape more then 500.000,00$, now that is a women who knows how to make make money.
The bigger problem is that she reacted wrong on the copyright infringement, a better way is to change the "official owner" in the contracts and move the server to a different country where Blizzard copyrights are limited or don't exist at all. There are several ways as private server to prevent such issues, Peyton made a mistake here and reacted wrong with the name change (No need to do that cause it doesn't helps at all).
We have here now a "David vs. Goliath" situation and I'm curios who will win.
Anyone got a copy of the original case complaint documents?

A wiseman once told me that it's hard to make a private server popular without DBCs and maps!
